Terms and Conditions – Short Programs
Terms and conditions of registration for the Australian Rural Leadership Foundation (ARLF) short programs.
These terms and conditions contain important information about your organisation’s registration, including ARLF’s cancellation policy. Please read carefully to ensure that you are aware of your rights and obligations.
As your organisation will be funding participants on the program, you will be defined as the Funder in these Terms and Conditions.
General
Program registration will not be complete until:
- the ARLF gives written confirmation that the Funder’s registration form has been approved; and
- the invoiced program fee is paid in full.
ARLF will issue an invoice upon the completion of the Funder’s organisation registration form.
With the ARLF incurring substantial costs prior to the commencement of a program, fees apply for any changes made to the Funder’s organisation registration form or participant/s application form/s.
Funder’s obligations
The Funder agrees that the statutes, rules and policies of the ARLF are binding and all fees, levies and charges directly arising from participation in the Program must be paid by the Funder.
The Funder agrees that delays in payments, without prior arrangements with the ARLF, may lead to the ARLF being unable to provide the full Program to the Participant.
The Funder acknowledges that any expenses or costs incurred by the ARLF in recovering any monies shall be the responsibility of the Funder, including debt collection agency fees and solicitor’s costs and all other reasonable costs incurred in the recovery of outstanding monies.
The Funder is responsible for payment of the fees and charges.
The ARLF’s obligations
The ARLF undertakes to invoice the Funder the fees and charges (the Funds).
The ARLF will ensure that the Program is conducted in a professional manner and in accordance with the stated objectives of the Program.
Notwithstanding any other term of these terms and conditions, if the course is delayed or cancelled due to reasons beyond the control or the ARLF, the ARLF may elect for the funds to be used to grant a placement in the delayed course.
With the Funder’s approval, the ARLF will acknowledge the financial support provided by the Funder, including use of the Funder’s logo as provided by the Funder:
- in the ARLF’s annual report
- on the ARLF’s website and in promotional publications
- in course directories
- at graduations and other major events.
Cancellations, transfers or substitutions
Cancellation
The ARLF understands that circumstances change, and unavoidable events occur. If the Funder needs to cancel registration, the ARLF requests that the Funder give at least 45 days’ notice.
Any cancellation made 90 days or less prior to the commencement of the program will incur a cancellation fee. Please refer to Table 1 for cancellation fees.
Non-attendance at a program is treated the same as a cancellation.
Transfer
Participants may transfer to an alternate program up to 45 days prior to the commencement of a program. The alternate program must be completed within 12 months from the commencement date of the original program. All transfer fees and any additional program fees must be paid to confirm registration in the new program. Please refer to Table 1 for transfer fees.
Transfer requests less than 45 days prior to the commencement of a program are not permitted. If you are unable to attend the program, this will be treated the same as a cancellation.
Substitution
The Funder may request to substitute another person to take participant on program. Please refer to Table 1 for substitution fees
Names and contact details of Funder nominated substituted participant must be received by the ARLF no later than 45 days prior to the commencement of the program

*The ARLF reserves the right to apply the above fees on a discretionary basis subject to the applicant’s personal circumstances
Indemnity and Insurance
The ARLF indemnifies the Funder against any loss suffered by the Funder as a result of any claim, action, suit, demand or proceeding for damage, loss, or injury arising out of the use of the Funds, except to the extent that damage, loss or injury arose through the negligence of the Funder.
- The ARLF shall, for these term and conditions, take out and/or maintain the following insurances:-A Public Liability insurance policy for a sum of not less than ten million dollars ($10,000,000) arising from any one event in respect of accidental death of or accidental bodily injury to persons, or accidental damage to property, arising out of or in the course of the conduct of the Program;
- A Worker’s Compensation insurance policy as required by law.
The ARLF shall ensure that the policies effected pursuant to this clause cover all contractors, sub-contractors, employees, licensees and invitees of the ARLF.
Disputes Resolution
All questions and matters in dispute will be negotiated and agreed between the parties in good faith by an appointed nominee of each party.
Force Majeure
Failure or omissions to carry out or to observe any of the conditions of these terms shall not give rise to any claim against a party or result in the breach of these terms and conditions if such failure or omission arises by reason of delay or inability to perform caused by an outbreak of communicable disease or infectious epidemic or pandemic which is the subject of a Commonwealth or applicable State or Territory Health Emergency declaration, and includes but is not limited to Covid-19 (Disease Outbreak), war whether declared or not, insurrection, strikes, inability to obtain material, fire, storm or other severe action or the elements, accidents, government restrictions or for any other cause whether like or unlike the foregoing, which are unavoidable or beyond the control of the relevant party.
Despite anything else in these terms and conditions, if a Disease Outbreak occurs prior to the Program or there is a risk of a Disease Outbreak in the ARLF reasonable opinion, the ARLF will use its best endeavours to postpone the Program, and this will not cause grounds for the Funder to withdraw from the program.
Confidentiality
The ARLF will keep any information supplied by the Funder in respect of the participant/s in confidence (‘Confidential Information’) for use within the ARLF for its internal administrative purposes, and will only disclose such Confidential Information to external Organisations where required by regulatory authority or law. Any Confidential Information disclosed to the ARLF under these terms and conditions will be handled in accordance with the ARLF policy and protocols on maintaining the confidentiality and privacy of information.
The Funder will keep any information supplied by the ARLF in respect of the participant/s in confidence (‘Confidential Information’) for use by the Funder for its internal administrative purposes, and will only disclose such Confidential Information to external organisations where required by regulatory authority or law. Any Confidential Information disclosed to the Funder under these terms and conditions will be handled in accordance with the Funder’s policy and protocols on maintaining the confidentiality and privacy of information, which if requested by the ARLF acting reasonably, must be amended and updated to ensure compliance with any regulatory authority or law.
